From October 2018 to September 2021, Lucas's pharmacies submitted almost $4 million in claims to Medicare and TennCare for dispensing costly foot bath medications that were not medically required and not eligible for reimbursement.
A Tennessee podiatrist, Nathan Lucas, was found guilty by a federal jury today for a fraudulent scheme involving Medicare and TennCare. Lucas, 59, owned a podiatry clinic in Memphis called Advanced Foot & Ankle Care of Memphis LLC, along with two in-house pharmacies.
He prescribed unnecessary foot bath medications, including antibiotics and antifungal drugs, for patients to soak their feet in. These medications were not meant to be dissolved in water, and some were not even water soluble. As a result, Lucas obtained millions of dollars in reimbursements through this deceitful practice.
Lucas made the decision to prescribe and dispense these medications based on how much he would be reimbursed, rather than what was medically necessary. From October 2018 to September 2021, Lucas's pharmacies submitted almost $4 million in claims to Medicare and TennCare for dispensing costly foot bath medications that were not medically required and not eligible for reimbursement. As a result, Lucas's pharmacies received over $3 million in reimbursements.
Lucas has been found guilty of five counts of health care fraud. His sentencing is set for June 20, and he could face up to 10 years in prison for each count. The final sentence will be determined by a federal district court judge, taking into account the U.S. Sentencing Guidelines and other legal factors.
