Serial Fraudster Daniel Thomas Broyles Sr., aka Dan Thomas, 66, of Malibu, for Multiple Investment Fraud Schemes: Lady Justice Weighs


When he discovered his indictment in August 2016, he changed his identity to "Daniel Cruz Torrez" and relocated to a different address in Mexico, aiming to obstruct the government's prosecution efforts. In addition to his involvement in the Niyato scam, Broyles was also implicated in another fraudulent scheme with EarthWater Limited.





A man from California, who was previously brought back from Mexico, has been handed a 4-year prison sentence for his involvement in two fraudulent investment schemes that targeted vulnerable victims, particularly the elderly. Court documents reveal that Daniel Thomas Broyles Sr., also known as Dan Thomas, played a key role in a high-yield investment fraud scheme centered on a fictitious company called Niyato Industries Inc.


Broyles conspired with Robert Leslie Stencil, the CEO of Niyato, and others to deceive investors. They falsely presented Niyato as a prominent player in the electric vehicle manufacturing industry, claiming to convert vehicles to run on compressed natural gas.


However, Broyles was well aware, or deliberately chose to remain ignorant, that Niyato was nothing more than a fraudulent entity with no actual operations or proprietary technology.

Instead of utilizing investor funds to promote Niyato's business, the majority of the money was distributed among the co-conspirators. In an attempt to evade law enforcement, Broyles fled to Mexico in June 2016 upon learning about the investigation. When he discovered his indictment in August 2016, he changed his identity to "Daniel Cruz Torrez" and relocated to a different address in Mexico, aiming to obstruct the government's prosecution efforts.


In addition to his involvement in the Niyato scam, Broyles was also implicated in another fraudulent scheme with EarthWater Limited. Alongside EarthWater's CEO, Cengiz Jan Comu, and other individuals, Broyles conspired to sell EarthWater stock through deceitful means. They made numerous false claims, including the misrepresentation that the funds raised from investors were being used to develop and operate the company's business. However, the truth was that Broyles, Comu, and their co-conspirators intended to primarily benefit personally from the invested funds.






After being extradited from Mexico in March 2022, Broyles faced legal consequences. In June 2022, he pleaded guilty to multiple charges, including conspiracy to commit mail fraud and wire fraud, mail fraud, and money laundering related to the Niyato scam.


Additionally, Broyles pleaded guilty to conspiracy to commit mail fraud and wire fraud in connection with the EarthWater fraud. It is worth noting that seven other defendants had already been convicted in relation to the Niyato scam. One of them, Stencil, received a 12-year and three-month prison sentence following a three-week jury trial.


Eleven additional defendants have admitted their guilt in relation to the EarthWater scam, with Comu being handed a 10-year prison sentence. The announcement was made by Acting Assistant Attorney General Nicole M. Argentieri of the Justice Department’s Criminal Division, U.S. Attorney Dena J. King for the Western District of North Carolina, U.S. Attorney Leigha Simonton for the Northern District of Texas, Inspector in Charge Tommy Coke of the U.S. Postal Inspection Service (USPIS) Atlanta Division, and Inspector in Charge Eric Shen of the USPIS Criminal Investigations Group. The Mexican authorities played a crucial role in extraditing Broyles to the United States, while the Justice Department’s Office of International Affairs provided significant assistance in ensuring his arrest and extradition.


The case was investigated by the USPIS, and Broyles was transported from Mexico to the United States by the U.S. Marshals Service. Both cases are being prosecuted by Trial Attorney Christopher Fenton of the Criminal Division’s Fraud Section. Trial Attorney Theodore Kneller of the Criminal Division’s Fraud Section and Assistant U.S. Attorney Mary Walters for the Northern District of Texas are also involved in prosecuting the EarthWater case.
