According to the complaint, Feedback Earth has violated the state’s Clean Air Act and Solid Waste Act, resulting in odors spreading from its Grafton facility. The situation reportedly worsened this summer when the company began processing lobster shells without the necessary approval from the Massachusetts Department of Environmental Protection (MassDEP).
The Massachusetts Attorney General's Office (AGO) has filed a lawsuit in Suffolk Superior Court against Grafton-based Feedback Earth, Inc., alleging that the company has been releasing unpleasant odors for months, affecting residents in nearby communities. The lawsuit claims that these noxious emissions stem from environmental permit violations and unsanitary practices at the facility, which processes food waste into animal feed.
The AGO is seeking a preliminary injunction to immediately halt the odor emissions, aiming to provide relief to local residents and businesses while ensuring the company complies with environmental regulations.
“Every community deserves fresh air and responsible neighbors. No one should be unable to enjoy their yard, walk their neighborhood, or open their windows because a company, even one with an important mission, is prioritizing its business over complying with reasonable and sound environmental laws and regulations that protect the health of our residents,” said Attorney General Andrea Joy Campbell.

Residents have lodged hundreds of complaints, stating that the odors have made it difficult to enjoy their yards or open their windows.
The lawsuit further alleges that Feedback Earth improperly stored food waste and processed spoiled food, all while failing to inform MassDEP about operational changes that may have intensified the odors. Residents also claim that the company has made it harder to report odor issues by altering the complaint hotline number and conducting unannounced visits to homes of those who complained.
“Diverting food waste from disposal and repurposing it for animal feed and other uses is important for both our solid waste and climate goals,” said Massachusetts Department of Environmental Protection (MassDEP) Commissioner Bonnie Heiple. “Ensuring that companies operate in ways that protect the health of their neighbors and the environment is of the utmost importance, and the state looks forward to putting an end to the conditions causing these odor issues.”
In addition to seeking immediate relief, the AGO is pursuing a permanent injunction to stop the odor emissions and impose civil penalties for the alleged violations.
This case is being managed by Assistant Attorneys General Zeus Smith and Jillian Riley from AG Campbell’s Environmental Protection Division, with support from various environmental analysts and legal counsel from MassDEP.
