In a decisive move to protect voter rights, Maryland Attorney General Anthony G. Brown has issued a cease and desist letter to the Center for Voter Information/Voter Participation Center (CVI/VPC) in Washington, D.C. The letter demands the organization immediately stop sending threatening communications to Maryland voters regarding their voting records.
The letters state, in part:
“We’re sending this mailing to you and to your neighbors to share who does and does not vote in an effort to promote election participation. While we have hidden the name and street number of your neighbors to protect privacy, these are true voting records.”
“We will be reviewing these records after the election to determine whether or not you joined our neighbors in voting.”
The cease and desist action follows numerous complaints about letters from CVI/VPC labeled as “Voting Report Cards.” These letters detailed whether recipients had voted in the last four elections and compared their voting histories to those of two neighbors. While the names and addresses of the neighbors were redacted, the implication of public exposure left many recipients feeling alarmed and intimidated.
The letters included statements such as, “We’re sending this mailing to you and to your neighbors to share who does and does not vote in an effort to promote election participation,” and warned that the organization would review voting records after the election to see if recipients had cast their ballots.
Under Maryland law, while it is permissible for a requestor to access voter registration lists, any attempt to influence a voter’s decision through intimidation or threats is strictly prohibited. Recipients of the CVI letters reported feeling threatened, shocked, and uncomfortable, believing their voting choices could be made public.
In his letter, Attorney General Brown has demanded that CVI enter into a legally binding agreement to cease sending such threatening letters. Additionally, he insisted that the organization refrain from publishing voter participation records post-election as a remedy for their intimidation tactics.
Marylanders have a right to vote free from fear and intimidation, and this action reinforces the state’s commitment to upholding the integrity of the electoral process. “Voting is one of the most important rights that Marylanders have,” said Attorney General Brown. “Any action that intimidates prospective voters, especially on the eve of such a consequential election, will not be tolerated. Let me be clear: these unnerving letters are unacceptable, and Maryland voters should know that their decision to vote this Election Day is entirely theirs to make.”
