Francesco Illiano, a resident of Mount Airy, Maryland, has admitted his guilt in an employment tax scheme.
A man from Maryland has pleaded guilty today for intentionally failing to pay employment taxes that were withheld from his employees' wages. Francesco Illiano, who resided in Mount Airy, was the owner and operator of two restaurants and a property management company, which collectively employed more than 100 individuals.
It was Illiano's responsibility to collect, account for, and remit the income, Social Security, and Medicare taxes that were withheld from his employees' wages. However, between April 2014 and July 2016, Illiano failed to pay these withholdings to the IRS.
Notably, Illiano had previously been assessed a Trust Fund Recovery Penalty for failing to pay over $1.4 million in taxes withheld from employees of five Green Turtle restaurants that he owned in 2011 and 2012. As a result, Illiano's actions caused a tax loss of over $1.7 million to the IRS.
On March 6, 2024, Illiano is scheduled to be sentenced and could face a maximum penalty of five years in prison. Additionally, he may be subject to supervised release, restitution, and monetary penalties.
The final sentence will be determined by a federal district court judge, who will consider the U.S. Sentencing Guidelines and other relevant statutory factors.
The announcement regarding this case was made by Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Justice Department's Tax Division and U.S. Attorney Erek L. Barron for the District of Maryland.
The IRS Criminal Investigation is currently conducting an investigation into this matter.
Trial Attorney Shawn Noud of the Tax Division and Assistant U.S. Attorney Jefferson Gray for the District of Maryland are responsible for prosecuting the case.
