Mitchell made his way to Douglas, Arizona, where he kidnapped a 15-year-old girl from her middle school, bound her, and took her to his apartment, where he sexually assaulted her.
Following two days of careful consideration, a jury reached a verdict, convicting Aaron Mitchell, a former U.S. Customs and Border Protection agent, on charges of federal civil rights violations and kidnapping. The case involved the sexual assault and abduction of a minor victim. Additionally, the jury determined that Mitchell's actions constituted aggravated sexual abuse, kidnapping, and led to bodily harm.
Over the course of a two-week trial, jurors were presented with evidence detailing a harrowing incident that occurred on April 25, 2022. On that day, Mitchell made his way to Douglas, Arizona, where he kidnapped a 15-year-old girl from her middle school, bound her, and took her to his apartment, where he sexually assaulted her.
“The heinous crimes committed against a young middle school student by an individual sworn to uphold the law are unspeakable,” said Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division. “This defendant had a duty to protect his community but instead he abused his power, kidnapped, cuffed and restrained a young girl, and repeatedly sexually assaulted her in his apartment for hours. With this verdict, the jury has done us all a great service by holding accountable this former federal law enforcement official. The Justice Department will continue to stand up for sexual assault victims, especially children, and we will prosecute law enforcement officials who break the law with every tool at our disposal.”
The trial revealed that Mitchell approached the young girl as she waited for school to begin, posing as a law enforcement officer and requesting her identification. After showing her his police badge and credentials, he coerced her into his vehicle, claiming he was transporting her to the police station. Instead of taking her to safety, he drove her far from her school, stopped the car, and restrained her hands and feet with two sets of handcuffs. The victim recounted that once she was secured, Mitchell warned her to comply with his demands, threatening harm if she did not.
“Mitchell not only broke his oath, but the trust instilled in him as a law enforcement officer. Public servants, particularly in law enforcement, must be held to the highest of ethical standards. Those falling short must be rooted out and firmly held accountable,” said Special Agent in Charge Jose A. Perez of the FBI Phoenix Field Office. “The FBI remains committed to uncovering those who attempt to hide their acts of violence behind the badge. We would like to thank our investigators and the Douglas Police Department for their support and assistance in this case.”
After the defendant coerced the victim into his apartment, he subjected her to multiple sexual assaults that lasted for several hours. Eventually, Mitchell took the victim back to the vicinity of the middle school where he had initially kidnapped her that morning, warning her to keep silent about the ordeal. However, the victim promptly informed her friends, family, and various law enforcement agencies about the abduction and the assaults. During a police interview, the defendant ominously stated that the victim “better hope I don’t get out of here.”
“We count on our law enforcement officers to protect children, schools and communities,” said U.S. Attorney Gary Restaino for the District of Arizona. “This defendant dishonored his badge and his colleagues by ignoring his oath and harming the most vulnerable among us. Thanks to the Douglas Police Department and the FBI for investigating this case with dedication and compassion, and for vindicating the rights of a courageous victim.”
A review of the defendant's cellphone uncovered a series of alarming searches related to rape and methods to silence someone. While holding the child captive in his apartment, he also searched online for information on how long it takes to smother a person.
A sentencing hearing will be scheduled in the future. Mitchell could face a life sentence in prison. A federal district court judge will decide the final sentence, taking into account the U.S. Sentencing Guidelines and various statutory considerations.
The investigation was carried out by the Douglas Police Department in collaboration with the FBI Phoenix Field Office and the Sierra Vista Resident Agency.
