Blake Hicks, a former deputy sheriff from Alabama, has been accused of committing a federal civil rights violation due to his use of excessive force.
A former Elmore County Sheriff’s Deputy, Blake Hicks, has been charged with a federal civil rights offense for using excessive force. The indictment, unsealed by a federal grand jury in Montgomery, Alabama, accuses Hicks of depriving an arrestee, identified as T.Q., of his civil rights under color of law.
According to the indictment, Hicks is charged with willfully using unreasonable force against T.Q. while he was handcuffed and lying on the ground. The indictment specifically alleges that Hicks punched and kicked T.Q. in or around the head, causing bodily injury.
If convicted, Hicks could face a maximum sentence of 10 years in prison. The final sentence will be determined by a federal judge, who will consider the U.S. Sentencing Guidelines and other statutory factors.
The announcement of the indictment was made by Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division, Acting U.S. Attorney Jonathan S. Ross for the Middle District of Alabama, and Special Agent in Charge Paul W. Brown of the FBI Mobile Field Office.
The FBI Mobile Field Office conducted the investigation into this case. The prosecution will be handled by Assistant U.S. Attorney Eric Counts for the Middle District of Alabama, Trial Attorney Laura-Kate Bernstein, and Special Litigation Counsel Michael J. Songer of the Civil Rights Division’s Criminal Section.
It is important to note that an indictment is merely an allegation, and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
