Attorney General Brown's Consumer Protection Division demands that a Baltimore-based home improvement contractor shell out $1 million, which includes reimbursing affected consumers.
Attorney General Anthony G. Brown made a significant announcement today regarding the actions taken by his Consumer Protection Division. They have successfully obtained a Final Order against Bryan O. Jones, a home improvement contractor based in Baltimore, and his company, BOJ & Sons Construction.
The order mandates that they pay over $1 million in restitution to affected consumers, along with civil penalties and costs. It has been discovered that BOJ & Sons accepted substantial deposits from at least 35 Maryland residents for various home improvement and renovation services, only to neglect their obligations and fail to deliver on their promises.
BOJ & Sons Construction and its owners had their licenses to sell and perform home improvement services suspended in October 2021. However, despite the suspensions, they defiantly continued to offer and sell home improvement services. Fast forward to October 2023, a hearing on the Consumer Protection Division's charges was conducted, and the long-awaited Final Order has finally put an end to those charges.
Furthermore, not only did the Division discover that the company and its owner had breached the Consumer Protection Act, but they also uncovered numerous instances where BOJ & Sons Construction had repeatedly violated Maryland laws pertaining to home improvement contractors.
These violations included accepting excessive deposits, as Maryland law restricts contractors to collecting only one-third of the contract amount as a deposit. Additionally, the company was found to have used contract forms that lacked necessary disclosures and had sold home improvement goods and services without the required licenses.
“Marylanders deserve to work with honest companies that keep their promises and deliver what they advertised. BOJ & Sons Construction not only took customers' money without delivering any goods or services, but they also broke the law by taking consumers’ money after losing their home improvement license,” said Attorney General Brown. “My Office will always protect Marylanders and ensure that companies that prioritize greed over honesty and integrity are held accountable.”
The Consumer Protection Division has mandated that Mr. Jones and his company reimburse all payments received from consumers during their unlicensed period, along with payments for services that were never rendered. It was discovered that a minimum of 35 of the company's past clients are entitled to $514,800. The Final Order from the Division demands that Mr. Jones and his company cover penalties and expenses amounting to over $485,000.
Apart from demanding compensation for consumers and enforcing fines and expenses, the Division has banned Mr. Jones and his company from accepting deposits or prepayments from consumers prior to delivering any services or goods, unless they both put up a $500,000 performance bond with the Division to safeguard consumers.
Mr. Jones and his company are bound by The Final Order to halt providing home improvement goods or services to consumers unless they adhere to Maryland's home improvement laws. This means they must obtain the necessary licenses, limit their deposit collection to one-third of the contract amount, safeguard consumers' deposits, and use contracts that include all the necessary disclosures.
BOJ & Sons Construction LLC had already been flagged by the Better Business Bureau for some serious issues. According to BBB files, this business has received an 'F' grade due to a consistent pattern of complaints. These complaints revolve around various aspects, including customer service problems, refund/exchange issues, service problems, and contract disputes. Customers have reported a lack of communication, funds being collected for unfinished work, difficulty in obtaining refunds, incomplete contracted work, and breach of contract.
